A POSH Act lawyer helps employers meet their legal duties and helps employees understand their rights under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. DM Legal Services supports businesses, institutions, complainants and respondents in Mulund, Mumbai and Thane.

What the POSH Act Requires
The Act protects women from sexual harassment at the workplace and requires every employer to provide a safe working environment. An employer with ten or more employees must constitute an Internal Committee (IC). Where a workplace has fewer than ten employees, or the complaint is against the employer, the complaint goes to the Local Committee at the district level. The law applies to offices, shops, factories, hospitals, schools, colleges, clubs and other organised and unorganised workplaces.
Employer Duties in Brief
- Constitute an Internal Committee with a Presiding Officer who is a senior woman employee, at least two employee members and one external member from an NGO or a person familiar with the issues. At least half the members must be women.
- Adopt a written anti-sexual harassment policy and display the penal consequences and the committee details.
- Conduct regular awareness programmes and orientation for the committee members.
- Assist the committee during inquiries and act on its recommendations.
- File an annual report with the District Officer and include the details in the annual report of the company or organisation where applicable.
Failing to comply can lead to a penalty of up to ₹50,000, with higher penalties and possible cancellation of licence or registration for repeated non-compliance.
How a POSH Complaint Is Handled
- Complaint: the aggrieved woman files a written complaint with the committee, generally within three months of the incident or the last incident. The committee can extend this by up to three months for reasons recorded in writing.
- Interim relief: the committee may recommend steps such as a transfer, leave or restraint on the respondent while the matter is pending.
- Conciliation: at the complainant’s request, the committee may attempt settlement, but not by way of money.
- Inquiry: the committee follows the principles of natural justice and should complete the inquiry within 90 days, then submit its report within ten days.
- Action: the employer should act on the recommendations within 60 days. Appeal lies to the court or tribunal under the service rules or as provided by the Act.
