Types of bail

In a bailable offence, bail is a matter of right. In a non-bailable offence the court decides after considering the facts. Since the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) replaced the Code of Criminal Procedure on 1 July 2024, regular bail in non-bailable cases is dealt with in Section 480, anticipatory bail (protection before arrest) in Section 482, and the special powers of the High Court and Sessions Court in Section 483. Default bail, where the investigation is not completed within the legal time, is under Section 187.

What courts consider

The seriousness of the offence and the punishment, the strength of the evidence, whether the person is likely to flee, tamper with evidence or influence witnesses, previous record, and the length of time already spent in custody. The Supreme Court has repeatedly held that bail is the rule and jail the exception, but it depends on the facts of each case.

Where to apply

Applications are made first to the Magistrate or Sessions Court, such as the courts at Mulund or Thane, and, if refused or in serious matters, to the Bombay High Court. Anticipatory bail is usually sought in the Sessions Court or the High Court.

Documents and details to keep ready

A copy of the FIR or complaint, arrest memo, remand papers, identity and address proof, details of the person standing surety, and proof of employment or family ties. Please never hand over originals without asking.

Conditions of bail

Courts commonly require surety, surrender of passport, regular reporting to the police station, and no contact with witnesses. Breaking a condition can lead to bail being cancelled.
