Gift Deed vs Will: Which Is Better for Your Family Property?

Gift deed vs will is a question many families in Mumbai and Thane ask: should I transfer my flat or land to my children now through a gift deed, or leave it to them through a will? Both are valid, but they work very differently. The right choice depends on how much control you want to keep, the cost, and the risk of future disputes. This gift deed vs will comparison explains the differences in simple terms.

Gift deed vs will comparison: effect, revocability, registration and probate in Mumbai

What is a gift deed?

A gift is the voluntary transfer of property, without payment, from the donor to the donee under Sections 122 to 129 of the Transfer of Property Act, 1882. For immovable property such as a flat or plot, the gift must be made by a registered document signed by the donor and attested by at least two witnesses (Section 123). The donee must accept the gift during the donor’s lifetime. Ownership passes immediately once the deed is executed and registered.

A gift cannot cover future property, and once completed it generally cannot be taken back unless the deed itself provides a lawful condition for revocation.

What is a will?

A will is a legal declaration of how you want your property distributed after your death. For most Hindus, Sikhs, Jains and Buddhists it is governed by the Indian Succession Act, 1925. It must be in writing, signed by the testator, and attested by at least two witnesses (Section 63). A will has no effect during your lifetime, and you can change or cancel it as many times as you wish.

Gift deed vs will: when a gift deed makes sense

  • You are sure you want the transfer now and do not need the property back.
  • You want certainty and to avoid probate delays for that asset.
  • The donee is a close family member and the stamp duty is nominal.

Gift deed vs will: when a will makes sense

  • You want to remain the owner for life and decide later.
  • Your family situation may change, and you want flexibility.
  • You want to divide different assets among different people, and name an executor.

Points to watch in housing societies

If the property is a flat in a cooperative housing society, the society’s procedures for recording the transfer, share certificate and any transfer fee apply whether the transfer is by gift or by will. Obtain the society’s documents early.

Tax considerations

Gifts of property received from specified close relatives are generally not taxed in the recipient’s hands, but gifts from others can be. The donee also inherits the donor’s cost and holding period for capital gains purposes when the property is later sold. Income-tax law has been re-enacted recently, so please confirm the current provisions with a tax professional.

Gift deed vs will: can you use both?

Yes. Many families gift one property now and make a will for the rest. A lawyer can draft the deed with suitable conditions, such as reserving the right to live in the property for life, and align it with your will so the two do not conflict.
